| YOUR SPECIALIZED LAWYERS FOR LABOR LAW
in Mannheim, Heidelberg and nationwide
| Litigation/Litigation
Labor law disputes before the labor and state labor courts (e.g. Mannheim Labor Court) are our strength. Here you need a lawyer (preferably a labor law specialist) with experience in court. We have accompanied several thousand labor court proceedings (as a judge or as a lawyer).
You can therefore draw on a wealth of process experience and process knowledge, which is very valuable in many tactically demanding situations. Dealing confidently with all process situations is therefore a matter of course for us.
We know the typical stumbling blocks in a labor court dispute and usually know what move the opposing party will make next.
Are you an employee and want to get the maximum severance pay? Then you are right with us. We know “both sides” and therefore know what makes the employer side tick.
- legal proceedings across all instances (dismissal protection actions, consent replacement procedures, other decision-making procedures, etc.)
- works constitution disputes (disputes with the works council, consent replacement procedures, decision-making procedures, etc.)
- collective bargaining disputes
- individual legal actions: protection against dismissal, remuneration, warnings, certificates, etc.
- severance pay
| Data protection law
Data protection law has recently become significantly more important and poses challenges not only for data protection lawyers, but also for companies. In operational practice, the interface to labor law plays a particularly important role. The entry into force of the General Data Protection Regulation (GDPR) has also drawn the attention of many companies to the handling of personal employee data.
The following topics, among others, may be relevant and are covered by our consulting spectrum:
- creation and design of data protection guidelines and policies
- passing on of personal data within the group
- introduction of IT systems and software applications (SAP, Workday; Salesforce, MS 365 etc.) and creation of corresponding company agreements
- access to employee emails
| Use of external personnel and temporary employment
The use of external personnel has many facets and is often very complex. In addition, there are often not only legal but also practical challenges when it comes to legal classification. As consulting lawyers, we have already supported many projects and can provide you with excellent support with our experience.
We draft contracts for temporary employment (both between the lender and the borrower and corresponding contracts with employees). In this respect, we have extensive experience, particularly with regard to the approval practices of the Federal Employment Agency.
- legal and strategic support with service and work contracts, temporary employment and the use of freelancers
- examination and adjustment of existing structures: risk analysis and improvement management
- contract drafting and contract adjustment of temporary employment contracts
- contract drafting and contract adjustment of framework agreements between lender and borrower
| Work 4.0
Digitalization and the merging of markets bring with them numerous labor law challenges. This not only affects implementation by employers, but also enforcement against employee representatives.
In addition, agile working methods are increasingly playing a role. We can help you, for example, to install a SCRUM that is compatible with labor law (also with reference to external development team members).
- flexible working time models
- matrix organization and in particular its clean implementation under collective law
- design of agile forms of work (also through company agreements)
- negotiation with employee representatives
| Contract drafting
We draft employment and service contracts for every group of employees (especially for senior employees, non-tariff employees, etc.). We also revise and update your existing employment contract templates. We also create and revise collective agreements, group agreements, general agreements and “normal” company agreements.
Experience has shown that only excellent and up-to-date employment contract templates can reliably prevent labor law disputes.
- target agreements
- compensation regulations
- employee shareholdings (LTIP, RSUs, virtual stock options and much more)
| Dealing with the works council/restructuring and restructuring
In co-determined companies, there are regular points of contact between the works council and management under labor law.
It is not uncommon for the operating parties to have different legal positions. We clearly show employers what legal powers they have and, if necessary, enforce their rights against the works council, for example in the conciliation board. We have extensive experience in supporting conciliation bodies (e.g. reconciliation of interests and social plan; risk assessments for software applications and other work equipment).
We also support you with all issues relating to operational changes.
- proceedings before the conciliation board
- legal disputes with the works council
- balancing of interests and social plan negotiations
- mass layoff notices
- collective social plan negotiations
| Support in day-to-day employment law business
Many companies are exposed to numerous labor law issues in their day-to-day human resources work. These can, for example, be questions regarding the effectiveness of warnings, works council hearings or certain contractual clauses. But certain implementation and behavioral questions for HR managers can also become relevant (e.g. which measures must be taken in compliance investigations against employees and when the two-week period of Section 626 Para. 2 BGB begins - see also here.).
We would be happy to support you with all of these questions with our extensive experience and broad knowledge of labor law.
- supporting the in-house teams with vacancies (e.g. parental leave) or workload peaks
- advice as an outsourced employment law department to support day-to-day business
